About David

David Berney earned a B.A. in political science from Lehigh University in 1989 and went on to receive his J.D. from the University of Pennsylvania in 1992. His academic path combined a liberal arts undergraduate education with three years at a law school known for its emphasis on litigation and appellate training. Those years shaped the legal approach he would carry into practice: attention to procedure, attention to precedent, attention to persuasive writing.

He began his legal career in Pennsylvania, where he established a practice that spans both state and federal courts. He is admitted to practice in Pennsylvania and before the U.S. Court of Appeals for the Third Circuit. Over time he has handled matters at trial and on appeal, developing a practice that moves between the courtroom and the briefing table.

Berney later co-founded Berney & Sang. At the firm he has combined trial work with appellate work. His files have included contested motions, evidentiary disputes and appellate briefs. He has taken cases through jury trials, bench hearings and appellate argument. That breadth gives him a practical sense of how decisions made at the trial level will play out on appeal.

Colleagues describe his work as grounded in procedure and precedent. He pays close attention to the record and to the rules that govern timing and preservation of issues. That attention shapes the way he prepares for hearings and drafts appellate papers. He tends to prioritize a clear statement of the facts, a tight exposition of legal error and a focus on the specific remedies a court can grant.

Outside the courtroom, Berney’s professional activities have included mentoring younger lawyers at the firm and coordinating appellate strategy across cases. He brings a practical, case-by-case approach to staffing and to the allocation of research and writing resources. That pragmatic model is aimed at keeping filings precise and litigation plans realistic.

He currently practices at Berney & Sang, where his practice includes civil litigation and appellate work in Pennsylvania and before the U.S. Court of Appeals for the Third Circuit.
