About Stewart
Stewart McMillan earned his law degree from Fordham University School of Law in 1994 after completing undergraduate studies at Georgetown University in 1989. He entered the legal profession in the mid-1990s at a time when courtroom experience often came early in a lawyer's career. McMillan's education placed him on a path toward trial work and courtroom practice.
Almost immediately after law school he joined the Westchester County prosecutor's office. In 1995 he served as an Assistant District Attorney for Westchester County. That role gave him routine exposure to busy dockets, contested hearings and jury trials. It also provided the foundation for the litigation work he would continue to pursue throughout his career.
He later moved into private practice and is listed as an attorney at McMillan, Constabile, Foster & Perone, LLP in 2005. There he handled matters that required appearances in both state and federal forums. His work during that period involved courtroom advocacy and client counseling across a range of disputes and investigations common to the New York metropolitan area.
In 2014 McMillan began practicing under his own name, operating as Stewart A. McMillan, Esq. He is admitted in New York and Connecticut and maintains eligibility to appear in several federal courts, including the Southern and Eastern Districts of New York, the Western District of New York and the District of Connecticut. He holds memberships in the Westchester County Bar Association, the New York State Bar Association, the New York City Bar Association and the Fairfield County Bar Association, links that reflect an active engagement in the region's legal community.
Colleagues and clients describe McMillan's approach as grounded in courtroom experience. He brings the habits of a prosecutor to private practice: preparing thoroughly, testing evidence before trial and pressing for results where appropriate. His background allows him to move between the mechanics of pretrial work and the demands of a trial calendar with relative ease.
Today McMillan practices under the name Stewart A. McMillan, Esq. He handles matters in New York and Connecticut state courts and in several federal districts, applying his trial experience to representation in both criminal and civil proceedings.
