David Fitzsimons built his legal foundation at Washington College and then earned a J.D. from Dickinson School of Law in 1984. He took the traditional route from law school into practice and has maintained an active presence in Pennsylvania courts and federal forums since.
Early in his career Fitzsimons concentrated on litigation. He moved through courtroom practice into roles that demanded not only advocacy but also dispute resolution skills. Over the years he has argued matters in the U.S. Court of Appeals for the Third Circuit and has been admitted to practice before the U.S. Supreme Court. He is also admitted in Pennsylvania and in several federal district courts, including the Eastern and Middle Districts of Pennsylvania and the Eastern District of Wisconsin.
Fitzsimons is a shareholder at Martson Law Offices. In that role he handles both trials and alternative dispute resolution. Colleagues describe him as steady in court and deliberate in settlement settings. He has served clients in civil litigation across a range of issues and has moved between advocacy and mediation depending on what each case required.
His involvement in bar organizations has been sustained and varied. He holds current memberships in the American Bar Association, the Cumberland County Bar Association and the Dauphin County Bar Association. He serves as Vice Chair of the Pennsylvania Bar Association’s Committee on Legal Ethics and Professional Responsibility, and he sits on the Pennsylvania Bar Association’s Alternative Dispute Resolution Committee. Locally he chairs the Cumberland County Bar Association’s ADR and Fee Dispute Committee.
A long-standing participant in Inns of Court activities, Fitzsimons is Master Emeritus of the James S. Bowman American Inn of Court in Harrisburg and continues as a Master of the Cumberland County Inn of Court in Carlisle. He is also a member of mediator panels for federal and county courts, including the Certified Mediator Panels of the U.S. District Court for the Middle District of Pennsylvania, the Cumberland County Bar Association Panel of Mediators and Arbitrators, and the Dauphin County Bar Association Mediators Panel.
Peers see him as someone who moves easily between contested hearings and negotiated resolutions. He has balanced courtroom work with committee leadership and mediation service for many years. He currently practices at Martson Law Offices, concentrating on civil litigation, mediation and arbitration matters.
