About James
James Tobia built a law career that began in the classroom and moved quickly into courtrooms across Delaware. He earned a B.A. from Rutgers University in 1995 and a J.D. from Cornell University in 1998. Those credentials set the stage for steady work at several of the state’s established firms before he launched his own practice.
Fresh out of Cornell, Tobia joined Richards, Layton & Finger, PA as an associate in 1998. He spent the early years of his career learning litigation and insolvency practice at that firm. In 2002 he moved to The Bayard Firm, again as an associate, where he continued to handle contested matters and client counseling. By 2005 he was practicing at Potter Anderson & Corroon LLP, listed as a lawyer on engagements that required navigation of Delaware’s specialized commercial and insolvency dockets.
In 2006 Tobia founded The Law Office of James Tobia LLC. He established the office to offer more direct client access and to take on matters across Delaware’s bankruptcy and federal courts. Over time he has taken cases to the U.S. Bankruptcy Court for Delaware and the U.S. District Court for Delaware, courts where many complex commercial disputes are heard.
Tobia holds a mediator certification from the Delaware Superior Court. He is also a member of the Delaware State Bar Association. Those credentials complement his courtroom work and allow him to serve as a neutral in alternative dispute resolution when parties prefer to seek negotiated outcomes.
Colleagues and clients have turned to him for work tied to bankruptcy and related litigation. He represents creditors and debtors in contested proceedings. He also handles issues that arise during restructuring, from motions and adversary proceedings to negotiation of settlements. On some matters he functions as a mediator, helping opposing parties narrow disputes and reach agreements outside trial.
Tobia’s practice reflects the particular demands of Delaware law. The state’s business-friendly courts and dense commercial docket shape the kinds of matters he accepts. He keeps a practice that mixes litigation, counseling and mediation, and he continues to accept cases in Delaware state and federal courts.
