About Heinz

Heinz Binder is a licensed attorney admitted to practice law in the State of California. He was admitted to the California State Bar in 1979. His license is currently in active status. Mr. Binder is a founding partner at Binder Malter Harris & Rome-Banks LLP, a law firm located in Santa Clara, California. He has been practicing law for over 41 years, serving clients throughout the Silicon Valley area.

Mr. Binder earned his Juris Doctor degree from the University of Santa Clara School of Law in 1979. Prior to law school, he completed his undergraduate education at the University of Wisconsin-Madison, receiving a Bachelor of Business Administration degree in 1976. During his time at Santa Clara University, he was actively involved in various legal seminars and workshops, enhancing his understanding of bankruptcy and commercial law.

Mr. Binder concentrates his practice in the areas of bankruptcy law, corporate restructuring, and commercial litigation. He represents both debtors and creditors in Chapter 11 and Chapter 7 bankruptcy proceedings, as well as in out-of-court workouts and debt restructurings. His practice encompasses all stages of litigation, including initial case evaluation, discovery, mediation, settlement negotiations, and trial proceedings in both state and federal courts. He also handles appeals related to bankruptcy and commercial law matters.

Throughout his career, Mr. Binder has handled cases in the Superior Court of California for the County of Santa Clara, the United States District Court for the Northern District of California, the United States District Court for the Eastern District of California, the United States District Court for the Central District of California, and the United States District Court for the Southern District of California. He has also appeared before the Ninth Circuit Court of Appeals. Prior to founding his own firm, he worked as an associate at a mid-size litigation firm in San Jose for five years.

Mr. Binder is an active member of the State Bar of California and holds memberships in several professional organizations, including the Bay Area Bankruptcy Forum, where he serves as a director, and the Santa Clara County Bar Association, where he previously served as Chairperson of the Debtor/Creditor Committee. He is also a member of the Congressman Don Edwards American Inns of Court. Mr. Binder has been recognized as a Northern California "Super Lawyer" in Bankruptcy & Creditor/Debtor Rights every year since its inception in 2004. He is fluent in German, allowing him to serve the diverse communities of the Bay Area effectively.
