About Mr. Nicklaus J.

Mr. Nicklaus J. Misiti earned his J.D. from the State University of New York at Buffalo in 2005, where he studied immigration law. His legal education included coursework and clinical experience tied to immigrant and refugee issues. That early exposure set the tone for the cases he would take on after graduation.

He entered practice in the years after law school and built experience in immigration matters across several forums. He is admitted to practice in New York and holds appellate admissions in the U.S. Courts of Appeals for the 2nd, 3rd and 9th Circuits. Those admissions allow him to handle appeals that originate in different regions of the country and to follow matters beyond the initial administrative or district court stages.

Over the last decade and more, Misiti has balanced administrative immigration work with federal appellate litigation. He represents individuals and families in removal proceedings, and he files petitions and appeals when cases move into federal court. His approach is pragmatic. He aims to identify legal routes that can produce relief and to present arguments that are suited to the particular tribunal and factual record.

He joined the American Immigration Lawyers Association in 2010 and remains a member. That involvement has kept him connected to developments in immigration rulemaking, precedent from federal courts, and practice trends that affect representation. Membership in a national professional organization has also provided access to continuing legal education and peer discussion on evolving topics such as asylum law, detention practice, and appellate strategy.

Misiti maintains a presence in the Hudson Valley and operates an office in Poughkeepsie. He handles matters that arise in New York state as well as appeals that proceed to federal circuit courts. Colleagues and clients describe his work as steady and detail-oriented. He continues to accept immigration cases, litigate appeals, and represent clients in proceedings before immigration courts and federal appellate panels. He currently practices immigration law, handling both district and appellate matters as well as New York-based immigration cases.
