About Michael Peter

Michael Peter Kushner built a foundation in the humanities before turning to law. He earned a B.A. in English, with a minor in law and jurisprudence, from Niagara University in 2001 after beginning his undergraduate studies in 1997. He then attended Vermont Law School from 2001 to 2004 and received his J.D. in 2004.

He moved into practice soon after law school and has spent much of his career on matters that require careful appellate work. Admissions include the New York bar and appearances in several federal appellate courts. Those credentials point to a practice that often sits above the fact-finding trial level and in the courts that decide legal questions on the records before them.

Kushner’s work has involved drafting appellate briefs and preparing for oral argument. He routinely addresses statutory and constitutional issues, preservation questions, and standards of review. Those tasks require tightly written briefs and an ability to identify the discrete legal errors that appellate courts review. He has worked in both federal and state settings and is admitted to practice in multiple federal circuits, which allows him to follow matters beyond a single district’s boundaries.

Colleagues describe him as methodical in parsing case law and attentive to procedural detail. He has been active in professional circles since the mid-2000s. That period of involvement has given him a chance to keep abreast of developments in appellate practice and procedural law. His background in English is apparent in his written work, where clarity of argument and structure carry weight alongside substantive legal analysis.

Today he maintains a practice based in New York. His admitted jurisdictions include New York and the United States Courts of Appeals for the 1st, 2nd and 4th Circuits. He handles appeals and related federal practice matters, concentrating on appellate briefing, oral argument preparation, and strategic case assessment.
