Born and raised in Flomaton, Alabama, Upton has deep roots in the state. He earned his Bachelor of Science in Secondary Education from the University of Alabama in 1985. Following his undergraduate studies, he pursued his Juris Doctor at the University of Alabama School of Law, graduating in 1992. This solid educational foundation laid the groundwork for a distinguished legal career. Throughout his career, Upton has handled many cases, including capital murder, drug offenses, and various misdemeanors.
Notably, he has represented clients in over 20 capital murder cases, achieving a remarkable record—none of these cases resulted in a capital murder conviction. His experience in high-stakes legal battles showcases his commitment to defending the rights of his clients and his expertise in criminal law. In addition to his legal practice, Upton has been actively involved in professional organizations that advocate for criminal defense attorneys. From 2001 to 2008, he served on the Board of Directors of the Alabama Criminal Defense Lawyers Association (ACDLA), contributing to the advancement of legal standards in the state. In 2010, he received the ACDLA President's Award, recognizing his outstanding contributions to the field.
Four years later, in 2014, he was honored with the ACDLA Merit Award for a jury trial in which his client was found not guilty of all 14 charges, including 11 Class A felonies—an impressive feat that shows his skill as a trial attorney. Upton's commitment to community service is equally commendable. He has served as a Deacon at First Presbyterian Church, demonstrating his dedication to his faith and community. His involvement extends to various organizations, including the Tuscaloosa Red Elephant Club, Big Brothers/Big Sisters, United Way, and Easter Seals. In his personal life, Upton is a devoted single father to two daughters in their 20s and twins in elementary school. Balancing his professional and personal responsibilities, he finds joy in spending time with his children. In his spare time, he enjoys playing golf, watching Alabama Football, and cooking, with a particular focus on Mexican and Southern cuisine.
