Michael David Fabiano is a licensed attorney admitted to practice law in the State of California. He was admitted to the California State Bar in 1993. His license is currently in active status. Mr. Fabiano is the founder and owner of Fabiano Law Firm, P.C., a law firm located in Carlsbad, California. He has been practicing law for over 30 years, serving clients throughout San Diego County and the broader Southern California region.
Mr. Fabiano earned his Juris Doctor degree from the University of California, Hastings College of the Law, where he graduated magna cum laude in 1993. Prior to law school, he completed his undergraduate education at Rice University, receiving a Bachelor of Arts degree in 1986. He also earned a Master of Science degree from the University of California, Berkeley, in 1988. During his time at Hastings, he was recognized for his academic excellence and graduated with honors.
Mr. Fabiano concentrates his practice in the areas of intellectual property law, including patent litigation, patent prosecution, and licensing. He also handles business litigation, trademark litigation, trade secret litigation, and intellectual property licensing and counseling. His practice encompasses all stages of litigation, including initial case evaluation, discovery, mediation, settlement negotiations, and trial proceedings in both state and federal courts. He has represented both plaintiffs and defendants, including individuals and corporations, in various complex legal matters.
Throughout his career, Mr. Fabiano has handled cases in the Superior Court of California for the County of San Diego, the United States District Court for the Southern District of California, the United States Court of Appeals for the Ninth Circuit, and the United States Court of Appeals for the Federal Circuit. He is also registered to practice before the United States Patent and Trademark Office. Prior to founding his own firm, he worked as an associate at several law firms, including Jones Day in Irvine, Lyon & Lyon LLP in San Diego, and Skadden, Arps, Slate, Meagher & Flom LLP in Palo Alto.
Mr. Fabiano is an active member of the State Bar of California and the Federal Bar Association. He has been named one of "San Diego's Top Attorneys" by San Diego Metro magazine. He served as the President of the Litigation Section of the State Bar of California from 2009 to 2010 and was a member of the Editorial Board of the American Intellectual Property Law Association’s AIPLA Quarterly Journal from 2007 to 2010. He also served as the Chair of the City of Carlsbad’s Independent Redistricting Commission, which redrew boundaries for the City Council districts of Carlsbad following the 2020 census, from 2021 to 2022. Mr. Fabiano is fluent in English and Spanish, allowing him to serve the diverse communities of San Diego County effectively.
