About Melissa Maria

Melissa Maria Gencarelli built her legal foundation in classrooms that emphasized history and international affairs, then turned that perspective toward the law. She earned a B.A. from Lehigh University in 2002, completing a double major in International Relations and History. She went on to receive her Juris Doctor from New York Law School in 2007.

Her admissions reflect a practice that crosses state and federal lines. Gencarelli is admitted to practice in New York and New Jersey and is authorized to appear before the U.S. Court of Appeals for the Second Circuit and the Federal Circuit. Those credentials allow her to handle matters at both trial and appellate levels, and to argue complex procedural and substantive issues in federal appellate courts.

Early in her career she worked on litigation that demanded careful legal research and precise briefing. Colleagues describe her style as methodical: she outlines the law clearly, identifies the controlling authorities, and frames arguments so judges can follow them. She has experience preparing briefs, motions and appellate filings, and she is accustomed to the schedules and pressures that come with court deadlines. She also navigates the interplay between state law questions and federal appellate procedure.

Gencarelli’s work shows an attention to legal detail. She approaches case law with an eye for precedent and statutory interpretation. That approach suits appellate work, where the record is already set and the legal question must be teased out from past proceedings. In practice she often weighs how trial-level rulings will read on appeal and which legal theories are likely to persist under scrutiny.

Outside the courtroom she keeps current on developments that affect appellate practice. She tracks federal circuit decisions and changes to appellate procedure. She also follows state court developments in New York and New Jersey, mindful that shifts in those courts can ripple into federal appeals. This habit of staying informed informs how she prepares cases and advises clients about the risks and benefits of pursuing appeals.

Gencarelli currently practices in matters that involve appellate advocacy and federal litigation. Her work spans briefing and argument in appellate courts, as well as handling related federal litigation tasks. She concentrates her current practice on appellate advocacy and federal litigation.
