About Mark

Mark Fleming built a legal career that moves between courts and counsel tables. His path has taken him from an undergraduate degree in 1994 to a string of influential clerkships and into private practice, where he has handled appellate matters at a major firm.

Fleming earned a B.A. from the University of King s College in 1994 and a J.D. from Harvard Law School in 1997. The academic record set the stage for a succession of clerkships that steered his professional interests toward appellate work and complex litigation.

He began his post-law-school clerkship in 1997 for Judge Michael Boudin on the U.S. Court of Appeals for the First Circuit. That experience introduced him to federal appellate procedure and opinion drafting at a high level. In 1999 he served as a law clerk for Justice John C. Major at the Supreme Court of Canada, crossing into a comparative judicial environment and gaining exposure to another common-law system. He later clerked in 2002 for Justice David H. Souter at the U.S. Supreme Court, an assignment that placed him at the center of the country’s highest court during a pivotal time.

After his clerkships, Fleming worked at Wilmer, Cutler, Pickering, Hale, and Dorr LLP. There he practiced in an environment that combined trial preparation, appellate briefing, and counsel work for complex matters. The firm experience complemented his courtroom background and allowed him to apply the skills honed during his clerkships to client representation and appellate argument.

Fleming is admitted in Massachusetts and is also admitted to practice before the U.S. Supreme Court. Those jurisdictions reflect the federal and state contours of his work and the appellate dimension of his career. He has moved between bench and bar in ways that suggest an emphasis on legal analysis, appellate brief writing, and oral argument. He currently practices in Massachusetts and handles appellate litigation and matters before the U.S. Supreme Court.
