About Lee
Lee Bergstein took a conventional path into law. He earned a Bachelor of Arts from Syracuse University in 2004 and a Juris Doctor from Brooklyn Law School in 2007. Those credentials anchored the early years of a career spent largely in public service and later in private practice.
After law school, Bergstein joined the Queens County District Lawyer’s office as an Assistant District Lawyer in 2007. He worked on trial-level matters and courtroom practice there. The job provided steady exposure to criminal prosecutions and courtroom procedures. It also gave him practical trial experience that shaped his approach to litigation.
In 2014 he moved to the Office of the New York State Lawyer General as an Assistant Lawyer General. That role broadened his work beyond county-level prosecutions. He handled matters that involved state-level interests and learned how to coordinate with other government agencies. The position required adapting to a different docket and a wider range of legal issues.
In 2016 Bergstein became a partner at Bergstein Flynn PLLC. The move marked his transition into private practice. At the firm he took on a mixture of civil and appellate work and counseled clients on matters that drew on his courtroom background and state-agency experience. He is admitted to practice in New York and in the United States Court of Appeals for the Second Circuit. He also maintains membership in the New York State Bar and remains an active participant there.
Colleagues describe Bergstein as methodical in trial preparation and direct in oral argument. He favors straightforward strategies in the courtroom and emphasizes clarity in written briefs. He has handled cases at county and state levels and argued matters in federal appellate proceedings. He has not sought public office and has not been listed in academic appointments or bar leadership roles in publicly available records.
Outside the courtroom he continues professional ties to the New York legal community. His trajectory—from a county prosecutor to a state-level attorney and then into a private firm partnership—reflects a mix of trial experience and state government work. As of 2026 he practices at Bergstein Flynn PLLC, where his work centers on litigation and appellate practice.
