About D. Maimon
D. Maimon Kirschenbaum earned his J.D. from Fordham University School of Law in 2005. He entered the profession at a time when employment litigation and class-action practice were expanding in New York. The Fordham degree provided a foundation in litigation and procedural law that has informed his courtroom work ever since.
He joined Joseph & Kirschenbaum LLP early in his career and became a partner in 2009. That partnership came relatively quickly and placed him in the thick of high-volume civil litigation. Over the years he has built a practice centered on trials, motion practice and negotiated resolutions. Colleagues and opposing counsel alike have come to expect a lawyer who prepares cases for trial and pursues them through all stages of litigation.
Kirschenbaum is admitted to practice in New York and before the U.S. District Courts for the Southern and Eastern Districts of New York. Those admissions allow him to bring federal and state claims on behalf of clients, and to file cases in courts that handle complex employment and class-action matters. His courtroom work includes arguing motions, conducting depositions and trying cases to juries or judges.
He holds memberships in the National Employment Lawyers Association and the New York State Trial Lawyers Association. Those affiliations reflect a practice oriented toward workplace disputes and civil litigation remedies. He participates in the professional community through those organizations, where he exchanges developments in case law and procedural strategy with other litigators.
In his day-to-day work, Kirschenbaum represents employees in wage-and-hour suits, discrimination and retaliation claims, and collective or class actions. He handles pleadings and discovery, pursues settlement where appropriate, and readies cases for trial when settlement does not resolve the dispute. His files often include federal claims alongside state-law causes of action, requiring coordination across jurisdictions and careful attention to procedural deadlines.
Clients and other attorneys describe his approach as straightforward. He emphasizes concrete preparation and keeping litigation moving. He balances courtroom advocacy against the practicalities of case resolution. At Joseph & Kirschenbaum LLP he continues to litigate employment cases and related civil matters, representing individuals in workplace disputes and pursuing remedies through both negotiated settlements and trials.
