About Brett
Brett Waltner studied business and economics before turning to law. He earned a B.A. in Business Administration and Economics from the University of Sioux Falls in 2004. He then went on to the University of South Dakota School of Law, where he completed his J.D. in 2007.
He began his legal career in public service. In 2007 he served as a deputy state's lawyer in Minnehaha County, a role that introduced him to courtroom practice and case management on a regular basis. He later moved into private practice and became a partner at Waltner Kolbeck & Scharffenberg in 2010. That partnership allowed him to handle a broader slate of civil and criminal matters and to build trial experience.
In 2017 he joined The Krause Law Office, P.C. as a lawyer. That period of his career involved individual client representation and courtroom work in state courts. Over time his practice continued to evolve and he moved among firms, taking roles that combined trial work, client counseling, and case preparation.
Waltner is admitted to practice in South Dakota and in Iowa. He is also admitted to the Federal District Court for the District of South Dakota. He maintains professional memberships in the South Dakota State Bar Association and the South Dakota Association of Criminal Defense Lawyers, affiliations that reflect ongoing ties to the state legal community.
Colleagues and clients have seen him on both sides of criminal cases. His early work as a deputy state's lawyer gave him prosecutorial perspective. Subsequent private practice has put him in defense and civil roles. He has handled courtroom proceedings, hearings, and case strategy across jurisdictions where he is licensed.
He currently maintains an office at Myers Billion LLP. There he continues trial and litigation work while representing clients in state and federal matters. His practice centers on criminal defense and litigation in South Dakota and Iowa and matters before the Federal District Court for the District of South Dakota.
He is active in local bar groups and in professional networks that serve trial lawyers. He continues to accept new matters through his office at Myers Billion LLP, where his practice centers on criminal defense and related litigation.
