About Brett Daniel
Brett Daniel Kaplan completed a steady academic progression at Florida International University. He earned his Bachelor of Arts in English in 2013, followed by a Master of Fine Arts in Creative Writing in 2017. He then returned to FIU for law school and received his Juris Doctor in 2021, concentrating his studies in employment discrimination.
His early legal work began while he was still in law school. In 2020 he served as a law clerk at Derek Smith Law Group, PLLC, where he gained practical exposure to employment litigation. After passing the bar, he joined the same firm as an associate in 2021 and continued to work on employment-related matters, moving from support and research roles into direct client representation.
In 2022 Kaplan took on a leadership role at Kaplan Employment Law as managing partner. The title reflects an early transition from associate-level practice to firm management and client-facing responsibility. He oversees case development and strategy and handles litigation and administrative proceedings on behalf of employees. His move to the firm marked a shift toward running a practice that centers on workplace disputes.
Kaplan practices in Florida and maintains memberships in several professional organizations. He is a member of the Broward County Bar Association and the Miami-Dade County Bar Association, and he holds membership in the American Bar Association. He also joined the National Employment Lawyers Association and the Florida chapter of NELA in 2021, indicating an ongoing connection to networks that specialize in employee-side employment law.
His background in creative writing and English shapes how he approaches legal work. Colleagues note that clear, persuasive writing is a regular part of employment litigation, and Kaplan’s academic training contributes to how he prepares pleadings, deposition summaries, and written arguments. He combines those skills with courtroom preparation and negotiation practice developed during his time at Derek Smith Law Group.
Clients and peers see Kaplan as an attorney who has moved quickly from law clerk to firm leadership. He has built a practice centered on handling disputes over discrimination, wages, and workplace policies. He currently represents clients in employment discrimination and other workplace claims at Kaplan Employment Law, where he serves as managing partner.
