About Benjamin
Benjamin Wagner completed his undergraduate studies in political science at Saint John’s University, earning a B.A. in 2005 after attending from 2001. He went on to study law at William Mitchell College of Law, where he received his J.D. in 2008. Those years shaped his interest in federal tax procedure and appellate work.
Wagner’s career has centered on federal tax practice and litigation. He is admitted to practice in Minnesota and before the United States Tax Court. He also holds admissions to the Eighth Circuit and the Federal Circuit, and he has worked on matters that involve appellate briefing and argument. His involvement with the Minnesota State Bar Association’s Tax Section includes service as past chair, a role that placed him in regular contact with colleagues across public and private practice.
He moved into tax practice at a time when courtroom procedure and statutory detail were becoming increasingly important for clients facing federal tax controversies. Over the years he has handled contested matters in the Tax Court and prepared appeals that travel to higher courts. His work requires careful attention to deadlines, preservation of issues for appeal, and clear record-building at trial—skills commonly tested in tax litigation.
Outside of litigation, Wagner has engaged in professional exchanges through the bar section he led. That role included organizing programs on tax procedure and appellate strategy and helping create spaces where practitioners discuss recent case law and regulatory developments. Peers have encountered him in panels and section meetings. The bar work complements his courtroom practice and keeps him current with shifting rules and precedent.
Wagner now practices under the name Wagner Tax Law. His office handles matters that arise in federal tax court and on appeal, and it advises clients on procedural posture and appellate options in contested tax disputes. He continues to maintain ties to the Minnesota bar and to participate in the MSBA Tax Section, drawing on his experience in Tax Court and appellate forums to guide clients through litigation and post-trial review.
He currently practices at Wagner Tax Law, where he handles tax litigation and appeals.
